Our client was charged with assault occasioning actual bodily harm after he drunkenly struck a stranger at a holiday retreat, causing the other man to fall over and strike his head on a concrete boat ramp, requiring stitches in the back of his head. Despite the serious nature of the facts, we persuaded the magistrate to deal with the matter by way of good behaviour bond and fine only, given the fact that our client was significantly provoked and was hard-working family man with no violent history.
